TERMS AND CONDITIONS FOR THE USE OF THE FTC.PL WEBSITE

PREAMBLE

These Terms and Conditions define the rules for the operation of the website maintained at www.ftc.pl, the rights and obligations of Users, and the scope of the Administrator’s liability. The website’s activities are based on the principles of transparency, professionalism, and respect for the law.

§ 1. DEFINITIONS

  • Administrator / Foundation – Transparent Company Foundation with its registered office in Warsaw (00-453), ul. Czerniakowska 145 lok. 1, entered into the register under KRS: 0000152792, NIP: 5213232731, REGON: 015449381.
  • Website – the internet platform available at https://ftc.pl, including all its subdomains and functionalities.
  • User – any natural person, legal person, or organizational unit without legal personality using the resources of the Website.
  • Services – all electronic services provided by the Foundation through the Website, including, in particular, information materials, contact forms, and publications.

§ 2. GENERAL PROVISIONS

  1. These Terms and Conditions constitute the legal basis for using the Website. Every User is obliged to comply with its provisions from the moment they enter the Website.
  2. Use of the Website is voluntary and free of charge, unless express provisions within the Website state otherwise.
  3. The technical requirements necessary for cooperation with the Administrator’s ICT system include having a device with Internet access and an up-to-date version of a web browser.

§ 3. RULES OF USE AND USER ETHICS

  1. The User is obliged to use the Website in a manner consistent with the law, good practice, and the principles of social coexistence, while respecting the personal rights of third parties and the intellectual property rights of the Foundation.
  2. The User is prohibited from providing unlawful content, including in particular:
    • Content violating the personal rights of third parties;
    • Content that is discriminatory, offensive, or pornographic;
    • Content that may disrupt the operation of the Administrator’s IT systems (viruses, malware).
  3. The Foundation reserves the right to moderate or remove content that violates the above rules without prior notice.

§ 4. INTELLECTUAL PROPERTY AND BRAND PROTECTION

  1. All content posted on the Website, including text, visual materials, databases, source code, logos, and trademarks, is subject to legal protection under the provisions of the Act on Copyright and Related Rights and the Industrial Property Law.
  2. The owner of the economic copyrights to the Website and the content contained therein is the Transparent Company Foundation or entities cooperating with it under separate licenses.
  3. Any copying, reproduction, modification, or public distribution of materials from the Website without the prior, express written consent of the Foundation is strictly prohibited and may result in civil and criminal liability.

§ 5. LIMITATION OF LIABILITY

  1. The Foundation makes every effort to ensure that the information contained on the Website is substantively correct and updated in real-time. However, it is for informational purposes only and does not constitute a binding legal opinion or professional advice.
  2. The Administrator is not liable for:
    • Temporary lack of access to the Website resulting from maintenance work or reasons beyond their control (force majeure);
    • Damage resulting from the improper use of the Website by the User;
    • Content and privacy policies applicable to websites to which links are provided on the Website.

§ 6. COMPLAINT PROCEDURE

  1. The User has the right to submit complaints regarding the functioning of the Website.
  2. Complaints should be sent electronically to: info@ftc.pl.
  3. A properly submitted complaint should contain a description of the problem and the User’s contact details.
  4. The Foundation shall consider the complaint within 14 calendar days. The response will be sent to the e-mail address provided by the person submitting the complaint.

§ 7. PROTECTION OF PERSONAL DATA

The rules for processing personal data and the use of cookies are described in detail in the FTC.pl Privacy Policy, which forms an integral part of these Terms and Conditions and is available in the dedicated section of the Website.

§ 8. AMENDMENTS TO THE TERMS AND CONDITIONS

  1. The Foundation reserves the right to unilaterally amend these Terms and Conditions to adapt them to changes in legal regulations or the technical development of the Website.
  2. Amendments shall enter into force on the date of their publication on the Website. Continued use of the site after changes have been introduced constitutes acceptance of those changes.

§ 9. FINAL PROVISIONS

  1. In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular the Civil Code and the GDPR.
  2. Any disputes will be resolved in the first instance through amicable means, and in the absence of an agreement – by the common court having jurisdiction over the Foundation’s registered office.
  3. These Terms and Conditions enter into force on the day of publication.
